1. Agreement to Terms
By accessing or using the Service, you agree to be bound by these Terms, our Privacy Policy, and our Acceptable Use Policy, all of which are incorporated herein by reference. If you do not agree, do not use the Service.
2. Description of Service
The Service is a web-based application designed to help educational institutions track curriculum delivery and completion. It allows Administrators to manage schools, users, and classes, and enables teachers to record class-level progress. Key modules include curriculum management tools, reporting dashboards, class communication logs, and assessment tracking.
3. User Accounts
3.1. Account Creation: User accounts are created by an authorised Administrator within a school or trust.
3.2. User Responsibilities: You are responsible for safeguarding your login credentials (password or third-party account) used to access the Service and for any activities or actions under your account. You agree not to disclose your credentials to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorised use of your account.
4. User-Generated Content and Conduct
You are solely responsible for all data, information, feedback, messages, notes, text, or other materials (“User Content”) that you upload, post, or otherwise make available through the Service. You agree to comply with our Acceptable Use Policy at all times. You must not post any User Content that you do not have the right to share or that contains any personal data of students or other sensitive information.
5. Licence to Your Content
You retain all ownership rights in your User Content. By submitting User Content, you grant Curriculum Tracker a non-exclusive, worldwide, royalty-free, sub-licensable and transferable licence to use, host, store, reproduce, and display that User Content as necessary to operate and provide the Service.
6. Data Protection
For the purpose of data protection legislation, you (the school or trust) are the Data Controller, and Curriculum Tracker is the Data Processor of the User Content and User Account Data you provide. Our processing of this data is governed by our Privacy Policy and our Data Processing Agreement (DPA), which is hereby incorporated by reference into these Terms.
7. Service Availability and Disclaimer
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. While we strive to ensure the Service is available and reliable, we do not warrant that the Service will be uninterrupted, secure, or free from errors or omissions.
8. Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.
9. Limitation of Liability
Nothing in these Terms excludes or limits liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot legally be excluded or limited. Subject to the foregoing and to the fullest extent permitted by law, Curriculum Tracker shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits or revenues. In no event will our aggregate liability for all claims relating to the Service exceed (i) £100 or (ii) the total amount of fees you paid us for the Service in the twelve (12) months before the event giving rise to the liability—whichever is greater.
10. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
